Studio Rental Agreement

By engaging to rent any MMVI affiliated studios through its websites or any of its apps (herein after referred to as the “Studio”) photography/videography studio you, the undersigned (herein referred to as the “Client”), hereby state that you have read, fully understand and agree to be bound by the following Studio Rental Agreement

Studio Bookings, Payments & Overtime

Bookings

All bookings are subject to availability. A valid membership or payment is required to confirm a booking. Hourly rate bookings require deposit payment at the time of booking. 

​

To confirm your booking date the full amount must be paid at the time of reservation. If the payment is not successfully processed your booking date will be automatically canceled. The Client must keep prompt attention to this payment ensuring the seamless continuation of their reservation. A confirmation notice will be delivered to the Clients email at the time of completion.

Payments

All payments must be made via our booking platform, we Accept direct credit card payments from all major credit card companies, including Visa, MasterCard, Discover and American Express.

​

Overtime

Overtime refers to any time outside the scheduled booking hours. It is crucial to emphasize that the Client must completely vacate the premises by the end of their scheduled session time. To prevent incurring overtime charges, kindly conclude your activities in a timely manner and return the studio to its original condition by the end of your rental period. Any overtime will be billed at the standard rate of $50 per hour, without any discounts applied.

Cancellation, Rescheduling & Refund Policy
 

Cancellations must be done at least 48 hours ahead of the booking for a full refund, otherwise the Client agrees to forfeit their booking fee.

We are dedicated to delivering exceptional service to our clients, prioritizing a seamless experience. We recognize that unforeseen circumstances might necessitate changes to the reservation. 

 

The Studio’s cancellation policy is designed to be accommodating. If the Client needs to cancel within 48 hours of the scheduled time, the Studio will refund 50% of the rental fee. However, changes made after this 48-hour window cannot be refunded. Insufficient notice for cancellations or rescheduling will result in a full booking fee charge. Cancellations and rescheduling can be done via the Clients booking confirmation email or the Clients membership dashboard or by contacting us via our website. This policy applies to all payment methods, including reservations paid with pre-paid hours from the Clients/Members account.

Refunds typically take around 5 business days to process and reach the Clients bank account, although some banks may show the refund within 1-2 days.

Equipment Rental & Payments
​

Payment for all equipment rentals is due upon order confirmation. The equipment will not be available for pickup until payment in full is met.  All rented equipment needs to be turned off and put back to fully locked positions when the rental period is completed. Clients are held responsible for any damage caused to Studio equipment or property during their booking.

Studio Usage Policy
​

The studio premises must be used responsibly and in accordance with the provided guidelines. No illegal or hazardous activities are permitted on the premises.

Each booking session allows for a limit of 10 people to be part of the Clients group, (Groups of 10 or more people and users deemed to have a heavy impact on the studio, will be charged an additional fee and/or cleaning security deposit.)

Security and Supervision

​

The Client is solely responsible for providing any security or supervision deemed necessary to keep the premises safe and ensure appropriate conduct of their guests during the rental period. The Studio does not provide any security personnel or supervision and assumes no liability for any incidents, injuries, damages or losses that occur as a result of the Client's rental and use of the premises. The Client will hold the Studio harmless from any claims or causes of action arising from or related to failure to provide adequate security or supervision for their rental event.

Prohibited Items
​

The following is a list of items that are prohibited inside any of our studios:

​

  1. Paint of any kind. 

  2. Open flames or equipment that produces high heat. This includes cigarettes, smoke bombs or any type of fireworks or candles.

  3. No swimming pools or large quantities of water that could cause a flood. 

  4. Ceiling String.

  5. No firearms, knives or weapons of any kind.

  6. Powdered Paint, Chalk or any other flour-like substance. These types of materials get stuck inside our equipment and cause internal damage over time. 

  7. Champagne or bottles that will be used to be sprayed inside the studio.

  8. No illegal or hazardous activities are permitted on the premises.

 

If the Client absolutely needs to bring in one of these items for the shoot, the Studio may be able to accommodate by taking the proper precautions. Contact the Studio before booking your shoot.

Cleaning Policy

The Client is responsible for maintaining the premises and all its contents and fixtures in the same condition as they were upon arrival. This includes ensuring the studio flooring is left undamaged and free of debris such as balloons, confetti, or smoke residue from the rental period. Additionally, any food, snacks, or drinks consumed during the rental period must be properly disposed of by the end of the session.

 

Furthermore, any items or props brought by the Client, including sets, props, or client-owned equipment, MUST BE REMOVED by the conclusion of the booking session. Any arrangement to leave items in the studio beyond the rental day must be agreed upon in writing before the rental date. Only paper tape is allowed on the floor; gaffer tape is not permitted. Additionally, all tape used on the floor must be removed before leaving the studio.

 

Failure to return the premises to the original order and cleanliness will result in a minimum cleaning fee of $250, which will be charged by the Studio.

Liability Disclaimer
​
General Liability Disclaimer

The Studio assumes no liability for personal injuries or property damage occurring within the premises. Clients and their guests enter at their own risk.

​

Equipment and Property Disclaimer

Clients are held responsible for any damage caused to studio equipment or property during their booking. The Studio assumes no liability for the loss, theft, or damage of Clients' personal belongings or equipment. Moreover, in the event of lost, stolen, or damaged rented equipment during your session, the full replacement cost will be charged to the Clients card on file. The individual listed as the booking party is liable for any incidents occurring within the studio during the scheduled booking period, including any rented equipment.

Safety Disclaimer

Clients are expected to adhere to all safety guidelines provided by the studio. The studio is not responsible for accidents, injuries, or health-related issues that occur during the rental period.

​

Supervision of Guests Disclaimer

Clients are responsible for the conduct and supervision of their guests while on the studio premises. Any damage or disturbance caused by Clients' guests will be the Client's responsibility.

​

Booking Party Liability

The individual or entity listed as the booking party is fully liable for any incidents, damages, or injuries that occur within the studio during the scheduled booking time.

​

Compliance with Laws and Regulations 

Clients are responsible for ensuring that their activities in the studio comply with all applicable laws and regulations. The Studio is not liable for any legal issues arising from Clients' activities.

​

Indemnification Clause 

Clients agree to indemnify and hold the photography studio harmless from any claims, losses, damages, liabilities, and expenses, including legal fees, arising out of or in connection with their use of the studio premises or equipment.
 

Governing Law

These terms and conditions are governed by the laws of the state of New York. Any disputes arising from these terms and conditions will be settled in the courts of Brooklyn, New York.

​

Attorney’s Fees

If there is a breach of this Agreement or a dispute related to it, the winning party can recover all costs and expenses, including reasonable attorney's fees, from the losing party.

Changes to Our Studio Rental Agreement

Members informed of any changes. If there are significant updates to our studio policies or membership agreements, we will notify you via our website and/or email.

By booking a session with any MMVI affiliated studios through the mmvi website or any of its apps, clients and members implicitly agree to adhere to these terms and conditions, which are designed to ensure a fair and transparent usage policy.
